These Terms of Service ("Terms") govern your access to and use of spacecoastchronicles.com (the "Site") and any photography, video, or services we ("Space Coast Chronicles", "we", "us") provide. By using the Site or purchasing prints, you agree to these Terms.

1. Intellectual Property

All photographs, videos, writing, design, code, and other content on the Site are © Space Coast Chronicles and protected by U.S. and international copyright law. All rights reserved. You may not download, copy, reproduce, republish, distribute, train AI/ML models on, or otherwise use any content from this Site without our prior written permission, except as expressly permitted below.

Permitted use: you may view content on the Site for personal, non-commercial use, and you may share links to public pages on the Site.

Prohibited use: screen-recording, scraping, mirroring, removing watermarks, or using any content for commercial purposes, in derivative works, in advertising, or as training data for machine-learning systems is strictly prohibited without a written license from us.

2. Prints & Purchases

Prints displayed in the archive are sold and fulfilled by SmugMug, Inc. When you click "Order Print" you leave our Site and complete your purchase on SmugMug's platform. Pricing, payment, shipping, returns, refunds, and disputes are governed by SmugMug's Terms of Service. We make no separate warranty of merchantability or fitness for any particular purpose with respect to fulfilled prints.

Print buyers receive a personal, non-exclusive, non-transferable license to display the print in private spaces. Resale, reproduction, or commercial display is not permitted.

3. Commissioned Work

If you engage us for commissioned photography, video, or production services, the scope, deliverables, license, and fees will be set out in a separate written agreement. In the absence of such agreement, all rights remain with Space Coast Chronicles.

4. Contact Form & Submissions

By submitting the contact form you confirm that the information you provide is accurate and that you have the right to share it. Do not submit confidential or sensitive information through the form.

5. Acceptable Use

You agree not to:

• Attempt to gain unauthorized access to the Site, its servers, or related systems.
• Interfere with, disrupt, or place an unreasonable load on the Site.
• Use automated systems (bots, scrapers, crawlers) to access content except for well-behaved search-engine crawlers obeying our robots.txt.
• Use the Site for unlawful purposes or in violation of any applicable law.

6. Third-Party Services & Links

The Site links to third-party services including SmugMug, social platforms, and others. We are not responsible for the content, policies, or practices of those third parties.

7. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPACE COAST CHRONICLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASES MADE THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold Space Coast Chronicles harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site or its content.

10. DMCA & Copyright Complaints

If you believe content on the Site infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to contact@spacecoastchronicles.com.

11. Governing Law

These Terms are governed by the laws of the State of Florida, U.S.A., without regard to its conflict of laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to that jurisdiction.

12. Changes

We may modify these Terms at any time. The "Last updated" date above will reflect the most recent change. Continued use of the Site after changes constitutes acceptance of the revised Terms.
